1. Seller identification

The products offered and sold on https://acquadisardegna.com are sold directly by Officina Profumiera Sarda S.r.l., a limited liability company with a sole shareholder, registered office and place of business at Via della Produzione 3/5, Zona Industriale San Marco, 07041 Alghero (SS), Italy — Tax code and VAT no. 02547170908, registered with the Sassari Companies Register under no. 02547170908, REA SS-184950, share capital EUR 30,000.00 fully paid up.

These General Terms and Conditions of Sale govern the offer and sale of products on the site and apply to all orders. We invite you to print or save a copy.

2. Formation of the contract

The order is placed by the Customer by submitting the order form, which sets out the product features, the price, the payment method and the delivery terms. After submitting the order the Customer receives an email acknowledging receipt, containing a summary of the purchase. The contract is concluded when the Seller confirms acceptance of the order.

3. Prices and payment terms

Product prices, shipping costs and payment methods are those shown on the site at the time the order is submitted. All prices include VAT. The Seller may change published prices at any time: changes do not affect orders already confirmed. In the event of an obvious error or omission in prices or payment terms, the Customer is asked to report it promptly to assistenza@acquadisardegna.eu, quoting the order number.

4. Payment methods

Credit card payments are processed through Stripe, Nexi and PayPal on a secure server using the SSL protocol. The Seller has no access to full payment card details, which are handled directly by the payment service provider. Bank transfer, cash on delivery and Satispay are also accepted, as indicated at checkout.

5. Shipping and delivery

Products are delivered in the manner and within the timeframes indicated on the site and selected by the Customer when ordering. Shipping costs are borne by the Customer and vary according to destination, weight and volume.

Pursuant to art. 61 of the Italian Consumer Code, the Seller delivers the goods without undue delay and in any event within 30 days of the conclusion of the contract, unless otherwise agreed. The times shown on the shipping pages are estimates. If delivery does not take place within the deadline, the Customer may request delivery within an additional appropriate period and, if that period also expires without delivery, is entitled to terminate the contract and obtain a refund.

For orders shipped outside the EU, customs duties and charges may apply; these are borne by the Customer and collected by the courier.

6. Passing of risk

Pursuant to art. 63 of the Italian Consumer Code, the risk of loss of or damage to the goods passes to the consumer Customer when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the goods.

7. Right of withdrawal

A Customer acting as a consumer has the right to withdraw from the contract without any penalty and without giving any reason within 14 (fourteen) calendar days from the day on which physical possession of the goods was acquired (art. 52 of the Italian Consumer Code).

To exercise the right of withdrawal it is sufficient to send, within that period, any explicit statement of the decision to withdraw. You may do so:

  • by writing to assistenza@acquadisardegna.eu;
  • by using the model withdrawal form available on the site;
  • by sending written notice, including by registered letter with return receipt or certified email, to the address given in section 1.

Use of registered post or of the form is not mandatory: any explicit statement is valid.

The Customer must return the goods within 14 days of communicating the withdrawal. The direct cost of returning the goods is borne by the Customer. Goods must be returned intact and, where possible, in their original packaging; the Customer is liable only for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

The Seller shall refund all payments received, including standard delivery costs, within 14 days of receiving notice of withdrawal, using the same means of payment used by the Customer. The refund may be withheld until the goods are received back or until the Customer supplies evidence of having sent them back, whichever is the earlier.

8. Exclusions from the right of withdrawal

Pursuant to art. 59 of the Italian Consumer Code, the right of withdrawal does not apply, among other cases:

  • to goods made to the Customer's specifications or clearly personalised;
  • to sealed goods which are not suitable for return for reasons of health protection or hygiene — such as perfumes and cosmetics — where they have been unsealed after delivery.

9. Legal guarantee of conformity

All products are covered by the 24-month legal guarantee of conformity provided for by arts. 128 et seq. of the Italian Consumer Code. In the event of a lack of conformity the Customer is entitled, free of charge, to have conformity restored by repair or replacement and, secondarily, to a price reduction or termination of the contract. To activate the guarantee, simply write to assistenza@acquadisardegna.eu enclosing proof of purchase and a description of the defect.

10. Limitation of liability

Nothing in these Terms limits or excludes the Seller's liability where this is not permitted by law, nor does it affect the mandatory rights granted to consumers by applicable legislation.

11. Customer obligations

The Customer undertakes to provide true and complete information when ordering. Orders may not be placed by minors. The Seller reserves the right to take legal action against any breach or abuse.

12. Personal data protection

Personal data are processed in accordance with Regulation (EU) 2016/679 (GDPR) and Italian Legislative Decree 196/2003 as amended by Legislative Decree 101/2018. 13. Governing law and jurisdiction

These Terms are governed by Italian law and, for matters not expressly provided for, by Legislative Decree 206/2005 (Italian Consumer Code).

For disputes with a Customer acting as a consumer, territorial jurisdiction lies mandatorily with the court of the place of residence or elected domicile of the consumer, pursuant to art. 66-bis of the Italian Consumer Code. For contracts concluded with parties not acting as consumers, the court of Sassari shall have jurisdiction.

14. Alternative dispute resolution

A consumer Customer may apply to the competent mediation and ADR bodies pursuant to arts. 141 et seq. of the Italian Consumer Code, without prejudice to the right to bring proceedings before the courts.

15. Amendments

The Terms applicable to each order are those in force at the time the order is submitted. The Seller may update these Terms: changes do not apply retroactively to orders already concluded.
